Impact of Charges and Conviction
Stalking is a Class 5 felony for the first offense. There may be exceptions under the authority of the court. If there is a second or subsequent offense you are potentially facing a Class 4 felony if the stalking offense was within seven years after the date of the prior offense. If there are temporary or permanent protection orders, injunctions, or conditions of probation or parole or any other court order the penalty becomes a Class 4 felony. This sentence will run consecutively with any other sentence imposed.
A criminal charge of Stalking will not result in registering as a sex offender unless there is a sex offense added to this criminal charge.
