Example of Menacing: A neighbor raises his gun in the air threatening a neighbor over a simple dispute but never fires the firearm, the neighbor is in fear of his life; or a disgruntled employee leaves the company parking lot and guns his car towards a coworker, the coworker fears he is in imminent danger. Menacing is established in all of these acts in some degree. The Menacing charge will be enhanced because of the use of a deadly weapon and the automobile. Additional criminal charges will likely be added.

Impact of a Conviction and Consequences
Menacing charges may be a Municipal Ordinance Violation or charged in county or district courts.
- Menacing is a Class 3 Misdemeanor which carries a maximum of six (6) months jail or possible probation with no more than 60 days as a condition of probation or:
- A Class 5 Felony if a weapon is present or a person represents themselves as armed with a deadly weapon. It does not have mandatory prison time but may carry 1-3 years prison with two (2) years mandatory parole.
