Drugs Crimes Defense Attorney in Denver, Colorado

Many of the drug laws were changed in 2011. When facing criminal charges for drug possession or other drug crimes in Colorado, it is important not to talk with the police or anyone else regarding the allegations. If law enforcement calls you for an interview make no statements without calling me first.

As a criminal defense lawyer experienced in defending clients charged with various drug crimes, I am able to quickly recognize the relevant issues and establish a defense strategy for clients facing drug possession or other drug violation charges. I have defended clients charged with everything from paraphernalia, marijuana, crack, cocaine, methamphetamines, heroin, prescription drugs, Xanax, oxycontin, and other controlled substances.

  • Drug Possession: Possession of Controlled Substances including marijuana.
  • Drug Distribution or Distribution Trafficking is simply passing illegal substances from one person to another. An exchange of money is not necessary.
  • Drug Manufacturing: If a person cooks cocaine into crack, or possesses the ingredients for meth, it is considered drug manufacturing.
  • Marijuana Cultivation: Prior to 2010, growing even a single marijuana plant was a felony in Colorado. Now, one to six plants is a Class One Misdemeanor. Any more is a felony. The may be a municipal, county or district court charge.
  • Marijuana and Paraphernalia Possession: The Denver municipal ordinance prohibiting possession of marijuana still sets the amount at one ounce or less even though the state offense has increased the amount to two ounces for the lowest offense level. Even though the penalties for the city ordinance and the state petty offense are only a $100 fine, the negative long-term criminal record consequences can be monumental.
  • Prescription Fraud: Prescription fraud cases also involve allegations of forgery and identity theft for illegally obtaining or possessing the prescription.
  • Special Offender: There are enhanced punishments for drug crimes that are second offenses (“special offender”) or higher, including those that involve repeat offenses and possession of drugs and weapons.

Even though the severity and quantities for drug possession have changed and made less severe, a conviction of any degree of felony or misdemeanor will have serious long term consequences beyond any sentence by the court. This will result in a criminal history showing up on a background check. This likely would prohibit you from getting a job, apartment or home purchase.

If you have been charged or arrested for drug possession or other allegation, I will work to create a defense strategy, challenge the policies, methods of obtaining evidence, analyze and evaluate alternative sentence means, and work efficiently to achieve a more favorable outcome. Often, obtaining rehabilitation and treatment immediately can be helpful in plea negotiations as well as negating intent.

Attorney Philip M. Smith has over 32 years of experience in criminal law.
Having served as a judge and 16 years as a district attorney
I understand every position in the courtroom.
