Denver DMV Hearing Attorney at Colorado Department of Motor Vehicle

Your Colorado driving privilege is in jeopardy if you are facing suspension or revocation and have upcoming DMV hearing scheduled. If you have received a letter from the Department of Motor Vehicle or a Notice from the officer that charged you with DUI informing you of your right to a DMV Administrative Per Se or Refusal Hearing, you must act quickly. You have seven (7) days to request a hearing.

DMV in Colorado will also send notice of suspension if you have too many points. Sometimes it is possible to get a “red” license also considered a restricted license that allows you to drive to work, school, and other limited and necessary purposes. There are conditions set by the State of Colorado for obtaining a red license.

Philip M. Smith has over 32 years of legal experience
as a private defense attorney,
as a former judge and district attorney
practicing in all areas of criminal defense law.

A Colorado DMV hearing determines the circumstances surrounding your traffic ticket or moving violation offense and a Colorado DMV Hearing Officer makes a determination about the validity of the suspension of your license. These hearings are informal, but testimony is under oath. The Hearing Officer will explain the purpose of the hearing and the decisions he will have to make. You do not have to testify but you will have the opportunity to ask questions. It is important to note that the Hearing Officer cannot offer you legal guidance.
